Wind and SPPs must be appraised before obtaining electricity activity licenses

The Ministry of Finance has just issued Circular No. 12/2020 /TT-BTC, stipulating that wind and solar power projects must be appraised before obtaining operation licenses as similar to hydropower and thermal power projects before.

In this Circular there are amending and supplementing issues in Section II, Part A, Table on the fee rates enclosed with the Circular No. 167/2016 / TT-BTC of the Ministry of Finance, where stipulating the collection rates and regime, payment, management and use of appraisal fees for awarding electricity activity licenses.

In this new circular, the name of the appraisal activity for granting electricity activity licenses has amended to comply with the provisions of Decree No. 17/2020 /ND-CP of the government, although the appraisal activities stipulated in more detail.

So, the appraisal fees for granting electricity activity licenses, implemented by the central agencies for wind and solar power projects are as follows:

For the projects with the installed capacities: < 10 MW, the appraisal fee is 10.6 million VND, from 10 to < 30 MW – 15 million, from 30 to < 100 MW – 18 million, from 100 to <300 MW – 24.5 million, from 300 up – 28.8 million.

Electricity Regulatory Authority (Ministry of Industry and Trade) and Departments of Industry and Trade of provinces and cities have responsibility to collect, pay, manage and use the appraisal fees for granting electricity activity licenses according to the regulations.

In case of amending or supplementing the license, the fee would be 50% of the fee for newly granting.

This fee may be paid directly or by bank transfer to the management agency.

The circular should take effect from April 17, 2020.
